Scope Boundaries (Who/What it applies to)

This SOW template governs all electrical installation, modification, and commissioning activities performed by Electrical Contractors on commercial projects within Ontario. It establishes clear operational boundaries for utility disconnection points (demarcation lines between local distribution companies and customer-owned infrastructure), high-voltage safety logs, and mandatory Electrical Safety Authority (ESA) inspection milestones. It applies to all low-voltage and high-voltage distribution systems, emergency power systems, and branch circuitry within the property line.

Mandatory Deliverables & Administrative Windows

• Pre-Construction Submittals: ESA Notification of Work filed within 48 hours of contract award; utility disconnection coordination plans submitted 14 business days prior to scheduled shutdown.
• Active Construction Logs: Daily high-voltage safety logs, lockout/tagout (LOTO) permits, and weekly ESA inspection progress updates.

Ontario Regulatory Compliance Notes

All electrical works must strictly comply with the current Ontario Electrical Safety Code (OESC) and ESA Standards. Estimating and project management workflows must account for the following statutory mandates under the January 1, 2026 Ontario Construction Act amendments:

• Proper Invoices: Submitted monthly invoices are legally deemed proper unless the owner delivers a formal written notice of deficiency within 7 days of receipt. Failure to issue this notice within 7 days forfeits the owner's right to dispute invoice structure and immediately triggers the 28-day prompt-payment clock.
• Annual Holdback Release: For multi-year electrical contracts, owners must publish a Notice of Annual Release of Holdback (Form 6) on an electronic construction trade news website within 14 days after each contract anniversary.
• Holdback Payment Window: Accrued basic holdback must be paid to the contractor between day 60 and day 74 following the publication of Form 6, provided no liens have been preserved.
• Repeal of Section 27.1: The former section 27.1 notice-of-non-payment mechanism for withholding holdbacks due to deficient or incomplete electrical work is repealed. Holdback retention is strictly limited to formal contract abandonment, termination, or preserved lien risk.
• Interim Adjudication: Parties have a strict 90-day window following contract completion, abandonment, or termination to initiate interim binding adjudication through ODACC or a qualified private adjudicator for any payment or scope disputes.

Form/Sign-off Requirements

• Utility Demarcation Agreement: Initialled site plan detailing the exact physical boundary of utility responsibility versus contractor responsibility.
