Scope Boundaries (Who/What it applies to)

This template defines the mandatory operational, technical, and administrative boundaries for plumbing subcontractors executing commercial works in Ontario. The scope encompasses all interior domestic water distribution, sanitary waste, vent piping, storm drainage systems, and the installation of commercial-grade fixtures.

The boundary of work begins at the point of service entry (typically 1.5 metres beyond the exterior foundation wall) and terminates at the final fixture connections. The plumbing contractor is solely responsible for verifying all rough-in limits against architectural and structural coordination drawings prior to core drilling or trenching. Any deviation from specified fixture rough-in tolerances must be reported immediately.

Furthermore, this scope strictly governs water shutdown coordination. The plumbing contractor is prohibited from isolating any active facility water lines without submitting a formal coordination request and obtaining written authorisation from the project manager.

Mandatory Deliverables & Administrative Windows

To maintain project velocity and ensure compliance, the plumbing contractor must execute and deliver the following documentation within the specified administrative windows:

  • Pre-Construction Submittals: Shop drawings for all fixtures, interceptors, and backflow preventers must be submitted for consultant review within 10 business days of contract award.
  • Water Shutdown Requests: Written coordination notices for system isolation must be submitted to the project manager a minimum of 72 hours prior to the scheduled shutdown.
  • Testing and Inspection Logs: Hydrostatic pressure test logs (minimum 2 hours at 150 PSI for domestic lines) and drainage peppermint or smoke test results must be signed off by the municipal inspector and third-party consultant within 24 hours of test completion.
  • Backflow Prevention Certification: Completed testing and cross-connection control certificates for all backflow preventers must be submitted within 5 business days of installation.
  • Closeout Documentation: As-built drawings, operation and maintenance (O&M) manuals, and manufacturer warranties must be delivered within 15 business days of substantial performance.

Ontario Regulatory Compliance Notes

All plumbing installations must comply with Ontario Building Code (OBC) Part 7 (Plumbing) and local municipal bylaws. In addition to technical standards, all financial and administrative aspects of this scope are governed by the Ontario Construction Act, incorporating the January 1, 2026 amendments under Bill 216 and Bill 60:

  • Proper Invoice Deeming: Subcontractor invoices are legally deemed proper unless the owner or general contractor delivers a formal written notice of deficiency within 7 days of receipt. Failure to issue this notice within the 7-day window forfeits the right to dispute invoice structure and immediately triggers the 28-day prompt-payment timeline.
  • Annual Holdback Release: For plumbing contracts extending beyond one year, owners must publish a Notice of Annual Release of Holdback (Form 6) on an electronic construction trade news website within 14 days after each contract anniversary. Payment of the accrued basic holdback must occur between day 60 and day 74 post-publication, provided no liens are preserved.
  • Repeal of Section 27.1: The former section 27.1 notice-of-non-payment mechanism for withholding holdback due to deficient or incomplete plumbing work is repealed. Holdback retention is strictly limited to formal contract abandonment, termination, or preserved lien risk.
  • Adjudication Window: Parties have a strict 90-day window following contract completion, abandonment, or termination to initiate interim binding adjudication through ODACC or a qualified private adjudicator for any disputed plumbing scopes or payments.

Form/Sign-off Requirements

  • Authorized Signatures: This SOW must be signed and dated by an authorised corporate officer of the plumbing subcontractor and the general contractor's lead project manager.
  • Page Initials: The plumbing subcontractor must initial each page of this document to acknowledge the fixture rough-in limits and water shutdown coordination protocols.
  • Change-Order Acknowledgement: No modifications to the specified plumbing materials, routing, or fixture models are permitted without a formal, signed Change Order prior to installation.
  • Record Retention: All signed testing logs, municipal inspection certificates, and backflow prevention records must be retained by both parties for a minimum of 6 years post-project completion.
