Scope Boundaries (Who/What it applies to)
This template governs all field personnel, subcontractors, and project managers engaged by Industrial, Mechanical & Utility Contractors who must enter designated confined spaces. It applies directly to physical entry into utility vaults, storage tanks, sewers, pressure vessels, and crawlspaces where hazardous atmospheres or entrapment risks exist. The scope covers mandatory pre-entry atmospheric testing, continuous gas monitoring, dedicated attendant (hole-watch) duties, and active rescue plan coordination. It does not apply to open-air trenching or standard excavations unless they interface directly with an enclosed, unventilated structure.
Mandatory Deliverables & Administrative Windows
- Pre-Entry Atmospheric Log: Completed and signed by a qualified gas tester within 15 minutes prior to any physical entry.
- Attendant Log: Continuous, real-time tracking of entrant names, entry times, and exit times, updated live at the access point.
- Rescue Plan Submission: A site-specific rescue plan must be submitted to the Constructor's safety coordinator at least 48 hours before work begins.
- Permit Cancellation: The active permit must be formally cancelled and filed with the Project Manager within 2 hours of shift completion or emergency evacuation.
- Closeout Records: All cancelled permits and atmospheric logs must be archived in the project safety file for a minimum of one year post-completion.
Ontario Regulatory Compliance Notes
All operations under this template must comply with the OHSA Confined Spaces Regulation & O. Reg. 632/05. This framework dictates strict safety administration, requiring estimators to budget for dedicated, non-working attendants and specialized rescue equipment.
Because safety compliance directly impacts project milestones, closeout, and progress payments, contractors must align their administration with the January 1, 2026 Ontario Construction Act amendments:
- Invoices are legally deemed proper unless the owner gives a formal written notice of deficiency within 7 days after receiving the invoice. Missing the 7-day notice window forfeits the right to dispute invoice form or structure and starts the 28-day prompt-payment timeline.
- For contracts extending beyond one year, owners must publish a Notice of Annual Release of Holdback (Form 6) on an electronic construction trade news website within 14 days after each contract anniversary. Payment of the accrued basic holdback must occur no earlier than day 60 and no later than day 74 after publication, provided no liens are preserved.
- The former section 27.1 notice-of-non-payment mechanism for refusing holdback distribution due to deficient or incomplete work is repealed. Holdback use is restricted to formal contract abandonment or termination scenarios and preserved lien risk.
- Parties have a strict 90-day window after contract completion, abandonment, or termination to initiate interim binding adjudication through ODACC or a qualified private adjudicator to resolve outstanding safety-related backcharges or payment disputes.
Form/Sign-off Requirements
- Qualified Gas Tester Signature: Verifies that oxygen levels, LEL, and toxic gas concentrations are within safe limits before any worker crosses the threshold.
- Entry Supervisor Authorization: Signed and dated activation of the permit, confirming all physical isolations (lockout/tagout) are complete.
- Attendant (Hole-Watch) Initials: Confirms continuous monitoring, communication equipment functionality, and rescue team availability.
- Entrant Sign-off: Individual worker signatures acknowledging review of the specific rescue plan and hazard controls.
- Closeout Sign-off: Signed by the Project Manager to verify safe exit of all personnel, sealing of the space, and formal permit termination.
