  • Operational Maintenance: Daily fluid checks, greasing, and minor field adjustments.
  • Off-Rent Demobilization: The administrative transition of liability back to the rental provider, defining the exact cutoff for rental charges and damage exposure.

Mandatory Deliverables & Administrative Windows

To maintain compliance and mitigate liability, the following deliverables must be executed within the specified windows:

  • Pre-Mobilization Submittals: Valid operator competency certificates (e.g., Working at Heights, hoisting/rigging credentials, heavy equipment tickets) must be submitted to the Site Superintendent 48 hours prior to equipment delivery.
  • Pre-Delivery Inspection (PDI): A joint physical inspection and signed PDI report, accompanied by high-resolution photographic evidence, must be completed within 2 hours of equipment arrival on site.
  • Daily Log Submissions: Completed daily pre-start inspection logs must be submitted to the Site Superintendent by 07:00 AM before any operational use.
  • Incident Reporting: Any mechanical failure, structural damage, or safety near-miss must be reported in writing within 2 hours of occurrence.
  • Off-Rent Notification: A formal written "Off-Rent Notice" containing the machine hours, fuel level, and time-stamped photos must be issued to the rental provider, establishing the exact time-stamp for the cessation of rental charges.

Ontario Regulatory Compliance Notes

Under the Ontario Occupational Health and Safety Act (OHSA), the Constructor maintains ultimate responsibility for equipment safety and operator competency on site. Furthermore, all financial and administrative aspects of the rental agreement must align with the Ontario Construction Act:

  • Invoice Disputes: Invoices for rental standby, mobilization, and operational hours are legally deemed proper unless the owner or General Contractor delivers a formal written notice of deficiency within 7 days of receipt. Missing this 7-day window forfeits the right to dispute invoice form or structure and immediately triggers the 28-day prompt-payment timeline.
  • Annual Holdback Release: For contracts extending beyond one year, owners must publish a Notice of Annual Release of Holdback (Form 6) on an electronic construction trade news website within 14 days after each contract anniversary. Payment of the accrued basic holdback must occur no earlier than day 60 and no later than day 74 after publication, provided no liens are preserved.
  • Holdback Restrictions: The former section 27.1 notice-of-non-payment mechanism for refusing holdback distribution due to deficient or incomplete work is repealed. Holdback use is strictly restricted to formal contract abandonment or termination scenarios and preserved lien risk.
  • Adjudication Timelines: Parties have a strict 90-day window after contract completion, abandonment, or termination to initiate interim binding adjudication through ODACC or a qualified private adjudicator to resolve any outstanding rental payment, damage, or backcharge disputes.

Form/Sign-off Requirements

  • Authorized Signatures: Wet or verified electronic signatures from the Project Manager, Site Superintendent, and Rental Agency Representative are required on the master rental agreement.
  • Operator Initials: The designated competent operator must initial the daily Pre-Start Inspection Log before starting the engine.
