Scope Boundaries (Who/What it applies to)
This template establishes the mandatory operational and administrative boundaries for all civil, utility, and excavation contractors executing earth-moving, trenching, or shaft-sinking activities on Ontario commercial, industrial, and institutional jobsites. The scope encompasses the physical limits of the excavation zone, heavy machinery operations, soil classification testing, protective support systems (such as trench boxes or engineered shoring), and strict access control/barricading. It applies to all personnel entering the excavation and governs the administrative controls required before ground break.
Mandatory Deliverables & Administrative Windows
- Pre-Excavation Window: Valid Ontario One Call locate tickets (active and verified on-site), soil classification report by a competent person, engineered shoring designs (for trenches exceeding 1.2 metres in depth where sloping is impractical), and a signed excavation permit.
- Active Work Window: Daily pre-shift inspection logs, continuous atmospheric testing records for deep trenches or potential confined spaces, and real-time vibration monitoring data.
- Closeout Window: Backfill compaction certificates, utility handoff notices, and signed permit closure documentation.
Ontario Regulatory Compliance Notes
Under *OHSA, O. Reg. 213/91 Part III*, excavations must be classified by a competent person into Type 1, 2, 3, or 4 soil. Any trench deeper than 1.2 metres requires a protective system (sloping, shoring, or trench boxes) designed in accordance with the regulation or stamped by a Professional Engineer.
Furthermore, financial and administrative controls must align with the January 1, 2026 Ontario Construction Act amendments (Bill 216 and Bill 60):
- Invoicing Protocol: Invoices are legally deemed proper unless the owner gives a formal written notice of deficiency within 7 days after receiving the invoice. Missing the 7-day notice window forfeits the right to dispute invoice form or structure and starts the 28-day prompt-payment timeline.
- Annual Holdback Release: For contracts extending beyond one year, owners must publish a Notice of Annual Release of Holdback (Form 6) on an electronic construction trade news website within 14 days after each contract anniversary. Payment of the accrued basic holdback must occur no earlier than day 60 and no later than day 74 after publication, provided no liens are preserved.
- Holdback Restrictions: The former section 27.1 notice-of-non-payment mechanism for refusing holdback distribution due to deficient or incomplete work is repealed. Holdback use is restricted to formal contract abandonment or termination scenarios and preserved lien risk.
- Adjudication Window: Parties have a strict 90-day window after contract completion, abandonment, or termination to initiate interim binding adjudication through ODACC or a qualified private adjudicator.
Form/Sign-off Requirements
- Competent Person Sign-off: Daily signature by the designated competent supervisor confirming soil type and protective system integrity.
- Locate Verification: Mandatory initialing of the physical locate marks on-site against the paper Ontario One Call paperwork.
- Engineering Approval: Professional Engineer (P.Eng.) wet stamp and signature on shoring drawings attached to the permit.
- Change-Order Acknowledgement: Written sign-off for any differing site conditions (e.g., transitioning from Type 2 to Type 4 soil) before work continues.
- Record Retention: Minimum retention of 7 years for all completed permits, daily logs, and locate sheets.
