Scope Boundaries (Who/What it applies to)

This template applies to all prime contractors, trade subcontractors, and mechanical specialists performing open-flame, spark-producing, or high-heat operations on Ontario commercial construction sites. The scope encompasses welding, thermal cutting, grinding, torch-applied roofing, and soldering. It establishes physical boundaries, requiring a minimum 11-metre (35-foot) clearance zone from all combustible materials, and administrative boundaries, restricting operations to designated hot work zones. All permits issued under this template are strictly time-bound and expire at the end of the designated shift, not exceeding a maximum duration of 12 hours.

Mandatory Deliverables & Administrative Windows

  • Pre-Work Authorization: Completed Hot Work Permit application submitted to the Site Superintendent at least 2 hours prior to work commencement.
  • Pre-Ignition Gas Testing: Atmospheric testing logs for confined spaces submitted 30 minutes before ignition.
  • Active Work Monitoring: Continuous fire watch logs and hourly combustible gas monitoring records maintained at the work face.
  • Post-Work Active Fire Watch: Mandatory 60-minute continuous physical fire watch immediately following the cessation of hot work.
  • Post-Work Monitoring Window: Secondary 3-hour electronic or physical thermal monitoring log of the work area.
  • Permit Closeout: Signed-off permit returned to the site safety office within 4 hours of shift completion.

Ontario Regulatory Compliance Notes

All hot work operations must comply with Sections 122 through 124 of O. Reg. 213/91 (Construction Projects), ensuring fire-extinguishing equipment is immediately available, combustible materials are shielded, and trained fire watch personnel are stationed.

Furthermore, all commercial contracts, invoicing, and closeout procedures associated with these specialized trade scopes are governed by the Ontario Construction Act. Project managers and estimators must administer these works under the following statutory controls:

  • Invoices submitted for hot work operations are legally deemed proper unless the owner delivers a formal written notice of deficiency within 7 days after receiving the invoice. Missing this 7-day notice window forfeits the right to dispute invoice form or structure and immediately starts the 28-day prompt-payment timeline.
  • For contracts extending beyond one year, owners must publish a Notice of Annual Release of Holdback (Form 6) on an electronic construction trade news website within 14 days after each contract anniversary. Payment of the accrued basic holdback must occur no earlier than day 60 and no later than day 74 after publication, provided no liens are preserved.
  • The former section 27.1 notice-of-non-payment mechanism for refusing holdback distribution due to deficient or incomplete work is repealed. Holdback use is strictly restricted to formal contract abandonment or termination scenarios and preserved lien risk.
  • Parties have a strict 90-day window after contract completion, abandonment, or termination to initiate interim binding adjudication through ODACC or a qualified private adjudicator to resolve payment, scope, or safety-related backcharge disputes.

Form/Sign-off Requirements

  • Permit Issuer Signature: Site Superintendent or designated Competent Person must sign to authorize the permit before any ignition occurs.
  • Performing Technician Initials: Lead welder, roofer, or mechanical technician must initial each safety checklist item, verifying combustible clearance and equipment integrity.
  • Fire Watch Sign-off: Dedicated fire watch personnel must sign the permit at the 60-minute post-work mark and the 4-hour final inspection mark.
  • Change-Order Acknowledgement: Any shift extension or scope change requires a new permit and written sign-off from the project manager.
  • Record Retention: Completed permits must be retained in the project safety registry for a minimum of 3 years.
