Scope Boundaries (Who/What it applies to)

This checklist applies to all mechanical prime contractors, sheet metal subcontractors, and certified Testing, Adjusting, and Balancing (TAB) technicians operating on commercial, institutional, and high-rise residential projects in Ontario. The scope encompasses the physical installation, startup, static testing, dynamic balancing, and final performance verification of all central air handling units, variable refrigerant flow systems, hydronic heating/cooling loops, energy recovery ventilators, and associated Building Automation Systems (BAS). It establishes the administrative boundary where mechanical installation ends and formal system handover to the owner begins, directly mitigating risks associated with premature warranty activation and unverified system performance.

Mandatory Deliverables & Administrative Windows

  • Pre-Commissioning Submittals: Manufacturer installation checklists, approved shop drawings, and BAS point-to-point verification maps must be submitted 14 days prior to commencing functional testing.
  • Active Commissioning Logs: Daily startup logs, equipment electrical data sheets, and preliminary TAB reports must be uploaded to the project management portal within 24 hours of test execution.
  • Closeout Deliverables: Final certified TAB report, Electrical Safety Authority (ESA) certificates, TSSA pressure piping authorizations, and signed BAS graphics validation must be delivered within 10 business days of achieving Substantial Performance.

Ontario Regulatory Compliance Notes

All HVAC commissioning activities must strictly comply with the Ontario Building Code (OBC) and CCDC Closeout Standards to ensure life-safety and environmental performance targets are met. Furthermore, all contract administration, invoicing, and closeout procedures associated with these commissioning deliverables are governed by the Ontario Construction Act, incorporating the January 1, 2026 amendments:

  • Proper Invoice Validation: Invoices submitted for commissioning milestones are legally deemed proper unless the owner delivers a formal written notice of deficiency within 7 days of receipt. Failure to issue this notice within 7 days forfeits the owner's right to dispute invoice structure and initiates the mandatory 28-day prompt-payment timeline.
  • Annual Holdback Release: For multi-year mechanical contracts, owners must publish a Notice of Annual Release of Holdback (Form 6) on an electronic construction trade news website within 14 days after each contract anniversary. Payment of the accrued basic holdback must be executed between day 60 and day 74 post-publication, provided no liens have been preserved.
  • Holdback Retention Restrictions: The former section 27.1 notice-of-non-payment mechanism for withholding holdback due to deficient or incomplete commissioning work is repealed. Holdback funds cannot be withheld for outstanding commissioning items unless formal contract abandonment or termination has occurred, or a lien has been preserved.
  • Dispute Resolution: Parties have a strict 90-day window following contract completion, abandonment, or termination to initiate interim binding adjudication through ODACC or a qualified private adjudicator to resolve outstanding payment or performance disputes.

Form/Sign-off Requirements

  • Commissioning Agent Sign-off: Certified digital signature on the final TAB summary and system performance matrix.
  • Mechanical Contractor Initials: Required on each page of the BAS point-to-point verification log to verify sensor calibration.
  • Owner Representative Acceptance: Signed and dated acknowledgement of system handover, establishing the official warranty trigger date.
  • Change-Order Acknowledgement: Written sign-off from the prime consultant confirming all commissioning-related design changes have been incorporated into the as-built drawings.
  • Record Retention: All signed checklists, balancing logs, and certificates must be archived in the project record for a minimum of 7 years.
