It specifically addresses the coordination of municipal inspectors, architectural and engineering field reviews, and the resolution of outstanding building deficiencies. This template governs the administrative boundary where construction completion intersects with statutory payment timelines and municipal sign-offs, mitigating the risk of delayed occupancy, withheld holdbacks, and unresolved deficiency claims.

Mandatory Deliverables & Administrative Windows

To ensure a compliant and structured closeout, the following deliverables and administrative timelines must be strictly maintained:

  • Pre-Closeout Inspection Schedule: Initiated 30 days prior to the targeted occupancy date to coordinate municipal inspector site visits.
  • General Review Commitment Certificates: Signed and sealed reports from all prime consultants (architectural, structural, mechanical, electrical) submitted to the authority having jurisdiction (AHJ) within 5 business days of final reviews.
  • As-Built Documentation & Balancing Reports: Final HVAC balancing, electrical safety authority (ESA) certificates, and fire alarm verification reports delivered to the owner and municipality 10 days before final inspection.
  • Deficiency Resolution Log: A comprehensive list of outstanding municipal or consultant deficiencies, updated weekly, with mandatory sign-offs from the respective subcontractors upon completion.
  • Occupancy Permit Application: Formal submission to the local municipality immediately following successful final inspections.

Ontario Regulatory Compliance Notes

All closeout activities must comply with the Ontario Building Code and municipal building permit requirements. Furthermore, project closeout and the transition to final payment are strictly governed by the Ontario Construction Act, incorporating the January 1, 2026 amendments:

  • Proper Invoices: Invoices submitted during closeout are legally deemed proper unless the owner gives a formal written notice of deficiency within 7 days after receiving the invoice. Missing this 7-day notice window forfeits the owner's right to dispute invoice form or structure and immediately starts the 28-day prompt-payment timeline.
  • Annual Holdback Release: For contracts extending beyond one year, owners must publish a Notice of Annual Release of Holdback (Form 6) on an electronic construction trade news website within 14 days after each contract anniversary. Payment of the accrued basic holdback must occur no earlier than day 60 and no later than day 74 after publication, provided no liens are preserved.
  • Holdback Restrictions: The former section 27.1 notice-of-non-payment mechanism for refusing holdback distribution due to deficient or incomplete work is repealed. Holdback use is strictly restricted to formal contract abandonment or termination scenarios and preserved lien risk.
  • Interim Adjudication: Parties have a strict 90-day window after contract completion, abandonment, or termination to initiate interim binding adjudication through ODACC or a qualified private adjudicator to resolve outstanding payment or deficiency disputes.

Form/Sign-off Requirements

  • Municipal Inspector Sign-off: Physical or digital signature of the municipal building inspector on the final inspection report.
  • Prime Consultant Sign-off: Signed and sealed General Review Commitment Certificates from all registered professionals of record.
  • Contractor Closeout Declaration: Signed acknowledgement by the General Contractor's project manager confirming all permit conditions have been satisfied.
  • Change-Order Reconciliation: Final sign-off on all outstanding change orders, confirming the final contract value prior to the final proper invoice submission.
  • Record Retention: All permit closeout documents, municipal certificates, and inspection logs must be retained in the project registry for a minimum of 7 years.
