Scope Boundaries (Who/What it applies to)
This checklist defines the mandatory administrative, safety, and financial onboarding boundaries for all trade subcontractors, sub-subcontractors, and specialty trade vendors operating on Ontario commercial construction projects. It applies directly to General Contractors and Site Supervisors executing project management controls. The scope encompasses the verification of commercial general liability insurance, active WSIB clearance status, site-specific safety orientations, trade-specific training credentials, and the alignment of payment administration with provincial legislation. It excludes direct-hire labour but strictly governs any third-party entity performing physical work on the project site.
Mandatory Deliverables & Administrative Windows
- Pre-Mobilization Window (14 Days Prior): Subcontractor must submit a valid Certificate of Insurance (COI) naming the General Contractor and Owner as additional insureds, a project-specific WSIB Clearance Certificate, a completed Form 1000 (Registration of Constructors and Employers), and a Site-Specific Safety Plan (SSSP).
- Site Arrival Window (Day 1): All trade workers must complete the site-specific safety orientation, submit proof of Working at Heights (WAH) and WHMIS 2015 training, and sign the site access log.
- Active Project Window (Ongoing): Subcontractor must submit updated WSIB clearance certificates every 90 days, weekly tool-box talk logs, and monthly progress claims.
- Project Closeout Window (Within 30 Days of Substantial Performance): Subcontractor must submit a Statutory Declaration (Form C-137), final WSIB clearance, as-built drawings, and operation and maintenance (O&M) manuals.
Ontario Regulatory Compliance Notes
This checklist is governed by the Occupational Health and Safety Act (OHSA), the Workplace Safety and Insurance Act (WSIA), and the Ontario Construction Act. Under the January 1, 2026 Ontario Construction Act amendments (Bill 216 and Bill 60), strict contract administration and payment controls must be enforced:
- Proper Invoice Disputes: Invoices are legally deemed proper unless the owner gives a formal written notice of deficiency within 7 days after receiving the invoice. Missing the 7-day notice window forfeits the right to dispute invoice form or structure and starts the 28-day prompt-payment timeline.
- Annual Holdback Release: For contracts extending beyond one year, owners must publish a Notice of Annual Release of Holdback (Form 6) on an electronic construction trade news website within 14 days after each contract anniversary. Payment of the accrued basic holdback must occur no earlier than day 60 and no later than day 74 after publication, provided no liens are preserved.
- Holdback Restrictions: The former section 27.1 notice-of-non-payment mechanism for refusing holdback distribution due to deficient or incomplete work is repealed. Holdback use is restricted to formal contract abandonment or termination scenarios and preserved lien risk.
- Adjudication Timeline: Parties have a strict 90-day window after contract completion, abandonment, or termination to initiate interim binding adjudication through ODACC or a qualified private adjudicator.
Form/Sign-off Requirements
- Subcontractor Representative Sign-off: Legally binding signature confirming that all submitted trade licences, insurance policies, and training records are valid and active.
- Site Supervisor Verification: Physical sign-off confirming the completion of the site safety orientation and verification of worker training credentials.
- Project Manager Approval: Final administrative sign-off verifying that the subcontract agreement is fully executed and the pre-mobilization package is complete.
- Change-Order Protocol Acknowledgement: Subcontractor initials confirming understanding that no extra work shall be executed without a signed Change Order or written Change Directive.
- Record Retention: Mandatory agreement to retain all safety, training, and financial records related to the project for a minimum of 7 years.
