Scope Boundaries (Who/What it applies to)

This template establishes the operational and administrative boundaries for identifying, tracking, and resolving physical construction deficiencies on Ontario commercial, industrial, and multi-residential projects. It applies directly to General Contractors, Site Supervisors, and all contracted subtrades. The scope encompasses all architectural, structural, mechanical, electrical, and civil works from the rough-in stage through to Substantial Performance and final contract closeout. By standardising the deficiency lifecycle, this tracker mitigates the risk of disputed trade assignments, missed rectification deadlines, lack of objective completion proof, and unlawful payment withholding.

Mandatory Deliverables & Administrative Windows

  • Pre-Mobilisation Deliverables: Trade-specific quality control plans, pre-existing condition surveys, and approved shop drawings.
  • Active Construction Deliverables: Weekly updated Deficiency Logs, formal Notices of Non-Conformance (NNC), and trade-specific rectification schedules.
  • Closeout Deliverables: Signed-off deficiency clearance certificates, high-resolution photographic proof of rectification, third-party engineering reports, and statutory declarations.
  • Notification Window: Subtrades must acknowledge a logged deficiency within 48 hours of notification.
  • Rectification Window: Standard deficiencies must be fully rectified and submitted for re-inspection within 5 business days of notification, or within 24 hours if the item impacts the critical path or site safety.

Ontario Regulatory Compliance Notes

Under the Construction Contract Closeout Standards and the January 1, 2026 Ontario Construction Act amendments (Bill 216 and Bill 60), deficiency management is directly tied to statutory payment timelines and holdback release:

  • Proper Invoice Validation: Invoices submitted by subcontractors are legally deemed proper unless the contractor delivers a formal written notice of deficiency within 7 days of receipt. Missing this 7-day window forfeits the right to dispute the invoice's form or structure and triggers the 28-day prompt-payment timeline.
  • Annual Holdback Release: For contracts extending beyond one year, owners must publish a Notice of Annual Release of Holdback (Form 6) on an electronic construction trade news website within 14 days after each contract anniversary. Payment of the accrued basic holdback must occur between day 60 and day 74 after publication, provided no liens are preserved.
  • Holdback Retention Restrictions: The former section 27.1 notice-of-non-payment mechanism for refusing holdback distribution due to deficient or incomplete work is repealed. Holdback funds cannot be withheld for minor deficiencies; holdback use is strictly restricted to formal contract abandonment, termination scenarios, or preserved lien risk.
  • Dispute Resolution: Parties have a strict 90-day window after contract completion, abandonment, or termination to initiate interim binding adjudication through ODACC or a qualified private adjudicator to resolve disputed deficiency costs.

Form/Sign-off Requirements

  • Site Supervisor Sign-off: Mandatory signature and date verifying that the rectified work meets the project specifications and quality standards.
  • Subtrade Representative Sign-off: Mandatory signature and date acknowledging completion of the rectification and accepting the closed status of the item.
  • Required Attachments: High-resolution before-and-after photographs, independent testing agency approvals (if structural or mechanical), and material delivery slips.
  • Change-Order Acknowledgement: Written authorisation from the General Contractor if the rectification work involves out-of-scope modifications.
  • Record Retention: All completed deficiency trackers, sign-offs, and supporting documentation must be archived and retained for a minimum of 7 years post-completion to align with statutory limitation periods.
