Scope Boundaries (Who/What it applies to)
This template applies to all road, utility, and civil contractors executing construction, maintenance, or utility works within municipal or provincial public right-of-ways (ROW) in Ontario. The scope covers the physical layout of temporary lane closures, detours, pedestrian bypasses, and construction staging areas. It governs the deployment, maintenance, and removal of temporary traffic control devices, including signs, channelizing devices, and Truck-Mounted Attenuators (TMAs). Administratively, this scope binds the contractor to municipal permit conditions, noise bylaws, and restricted working hours, while establishing safety boundaries to protect workers from vehicular traffic exposure and maintain emergency vehicle access.
Mandatory Deliverables & Administrative Windows
- Pre-Mobilization Submissions: Stamped Traffic Control Plan (TCP) compliant with OTM Book 7, approved Municipal ROW Permit, and Certificate of Insurance naming the municipality as an additional insured, submitted at least 14 business days prior to occupancy.
- Daily Operations Logs: Pre-shift Traffic Control Log, daily sign-check inspections completed at the start, middle, and end of each shift, and Paid Duty Officer (PDO) booking confirmations.
- Incident Reporting Window: Immediate verbal notification and written incident report submitted within 2 hours of any traffic-related near-miss, property damage, or public intrusion into the work zone.
- Project Closeout Deliverables: Post-construction ROW restoration sign-off, municipal permit closure certificate, and final removal log of all temporary traffic control devices within 24 hours of substantial completion.
Ontario Regulatory Compliance Notes
All traffic control layouts, signage spacing, and taper lengths must strictly adhere to the Ontario Traffic Manual (OTM) Book 7 (Temporary Conditions). Estimators must account for the cost of certified Traffic Control Persons (TCPs), TMAs, and variable message signs (VMS) required by municipal permit conditions.
Contract administration, invoicing, and closeout under this scope are governed by the Ontario Construction Act:
- Proper Invoice Validation: Invoices submitted by civil contractors are legally deemed proper unless the owner delivers a formal written notice of deficiency within 7 days after receiving the invoice. Missing this 7-day notice window forfeits the owner's right to dispute invoice form or structure and starts the 28-day prompt-payment timeline.
- Annual Holdback Release: For contracts extending beyond one year, owners must publish a Notice of Annual Release of Holdback (Form 6) on an electronic construction trade news website within 14 days after each contract anniversary. Payment of the accrued basic holdback must occur no earlier than day 60 and no later than day 74 after publication, provided no liens are preserved.
- Holdback Refusal Restrictions: The former section 27.1 notice-of-non-payment mechanism for refusing holdback distribution due to deficient or incomplete work is repealed. Holdback withholding is strictly restricted to formal contract abandonment, termination, or preserved lien risk.
- Interim Adjudication: Parties have a strict 90-day window after contract completion, abandonment, or termination to initiate interim binding adjudication through ODACC or a qualified private adjudicator to resolve payment or scope disputes.
Form/Sign-off Requirements
- Traffic Control Plan Approval: Stamped approval signature from a licensed Ontario Professional Engineer (P.Eng.) or qualified traffic coordinator.
- Daily Log Verification: Daily sign-off by the on-site Traffic Control Supervisor confirming all OTM Book 7 setups match the approved plan.
- Permit Compliance Sign-off: Written sign-off from the municipal inspector upon completion of ROW restoration.
- Change-Order Acknowledgement: Signed authorization from the General Contractor or Owner's Representative for any field-directed modifications to the approved TCP that incur additional equipment or labour costs.
- Record Retention: Mandatory retention of all daily traffic logs, permit approvals, and sign-check records for a minimum of 7 years to mitigate civil liability.
