Scope Boundaries (Who/What it applies to)

This register applies to all constructors, general contractors, site supervisors, and subcontractors executing work on Ontario construction projects where workers are exposed to fall hazards requiring fall protection systems. The scope encompasses the mandatory verification of training credentials for any individual accessing a work surface where a fall hazard of 3 metres or more exists, or where safety systems (such as guardrails, travel restraints, or personal fall arrest systems) are deployed. It establishes the administrative boundary for site access control, ensuring no worker mobilises without verified, active credentials.

Mandatory Deliverables & Administrative Windows

  • Pre-Mobilisation Submission: Subcontractors must submit valid Chief Prevention Officer (CPO)-approved Working at Heights (WAH) certificates for all personnel 5 business days prior to site mobilisation.
  • Site Orientation Log: Site Supervisors must complete the site-specific fall protection orientation log before issuing site access passes.
  • Daily Inspection Records: Workers must submit signed daily pre-use inspection logs for all personal fall arrest equipment to the Site Supervisor before starting each shift.
  • Weekly Register Audits: Site Supervisors must audit the training register weekly to identify upcoming certificate expiries (validity is 3 years from the date of issue).
  • Closeout Archiving: The completed register and associated training records must be archived within 10 business days of project completion.

Ontario Regulatory Compliance Notes

Under the Occupational Health and Safety Act (OHSA) and its Working at Heights Training Regulations, failure to maintain an active, verified training register exposes constructors to severe Ministry of Labour, Immigration, Training and Skills Development fines and stop-work orders.

From a commercial and contract administration perspective, safety compliance is directly linked to project cash flow and closeout. Under the 2026 Ontario Construction Act amendments:

  • Proper Invoice Validation: Progress draws and invoices are legally deemed proper unless the owner delivers a formal written notice of deficiency within 7 days of receipt. Missing this 7-day window forfeits the owner's right to dispute invoice form or structure, immediately triggering the 28-day prompt-payment timeline.
  • Annual Holdback Release: For multi-year projects, owners must publish a Notice of Annual Release of Holdback (Form 6) on an electronic construction trade news website within 14 days after each contract anniversary. Payment of the accrued basic holdback must occur between day 60 and day 74 post-publication, provided no liens are preserved.
  • Holdback Refusal Restrictions: The former section 27.1 notice-of-non-payment mechanism for refusing holdback distribution due to deficient or incomplete work is repealed. Holdback withholding is strictly restricted to formal contract abandonment, termination, or preserved lien risk.
  • Dispute Resolution: Parties have a strict 90-day window following contract completion, abandonment, or termination to initiate interim binding adjudication through ODACC or a qualified private adjudicator to resolve outstanding payment or compliance disputes.
